When you register on our Sites or use our Sites or Services, we collect your Personal Information. The term “Personal Information” encompasses data that specifically identifies you, such as your name, phone number, email, and postal address, and any other information associated with you deemed to be personal under applicable privacy laws.

WizCaller collects information on the individuals who interact with our business customers through the dedicated communication channels established by our business customers with WizCaller. This information includes, but is not limited to: (1) the individual’s contact details; (2) the name displayed on the communication interface; (3) recordings and transcripts of interactions you have with us or our customers when using our Services; and (4) other data correlated through our business customer’s data sources, personal data sources, and third-party data services. This data is aggregated to present relevant user information related to incoming interactions. The transmission of such data is secure, and we do not store data longer than necessary for business purposes, nor do we share this data outside of the Services. We may utilize this data to enhance the accuracy of user information, provide insights to our customers regarding interaction locations, describe the types of businesses that connect with our customers, and analyze interaction histories for analytics purposes.

Additionally, we gather information on visitors to our websites via our JavaScript, as elaborated in our Cookie Notice. This data may include IP address, User Agent, URLs visited on our websites, and other information accessible through the JavaScript code installed on our websites. We employ various analytics tools to study the activities of our customers on our Sites and Services.

Opting out of providing Personal Information can be done by not entering it when prompted or by adhering to the guidelines provided elsewhere in this Privacy Notice and our Cookie Notice.

5.1 How WizCaller Utilizes Your Personal Information

The personal information provided to WizCaller, or to our customers who utilize our Services to interact with you, may be employed to:

5.2 Opting Out of WizCaller Marketing in the United States

Existing customers can either send an email to support@wizcaller.com or submit a ticket through the provided support channels. You may manage your preferences to stop receiving specific types of marketing communications, such as emails. If you prefer not to be contacted via text, simply reply ‘stop’ to any text message from us. Some exceptions may apply to fulfilling your request, especially for communications that are vital for the use of our Services.

We may also send you emails about updates to the Services and other information regarding WizCaller, including promotions, contests, and events. Rest assured, your email will not be distributed or shared with third parties. You can opt out of receiving any future marketing communications by emailing support@wizcaller.com at the time it is distributed or when registering for the Service.

5.3 Opting In to WizCaller Marketing for Non-US Customers

If you are a customer residing outside of the United States, you might need to provide us with your explicit consent to be contacted by us or to receive such information from us when you register to use the Services by choosing to opt in. 5.5 Privacy Rights for California Residents

This segment of our Privacy Policy is specifically applicable to consumers residing in California. Where there’s a discrepancy between this section and others in this Privacy Policy, California residents are governed by this section.

Residents of California possess the right to be informed regarding the collection, usage, disclosure, and sale of personal information. Under the California Consumer Privacy Act (“CCPA”), consumers hold the right to ask for disclosure and deletion of their personal information, to opt-out of the sale of their personal information by a business, and the right not to face discrimination for exercising their privacy rights. WizCaller does not engage in the selling of personal information of California consumers and adheres to nondiscriminatory practices in response to privacy rights requests.

In the section titled, “Collection of Personal Data,” we detail the Personal Information collected in the twelve (12) months preceding the effective date of this Privacy Policy. The information encompasses:

  • Identifiers including name, address, email address, phone number, and more as outlined in the “Collection of Personal Data” section.
  • Categories of Personal Information as per California Civil Code §1798.80(e) including identifiers and information relating to an individual that is described in “Collection of Personal Data”.
  • Characteristics of protected classifications under federal or California law.
  • Commercial information about orders, registrations, and information provided or submitted during events, programs, surveys, or other promotions.
  • Internet or other electronic network activity information, geolocation data, and audio information from calls to customer service and accounting centers.
  • Inferences drawn to create a consumer profile reflecting preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes based on collected information.

Disclosures of Personal Information

WizCaller does not sell consumers’ Personal Information to third parties for monetary value. However, “sale” under the CCPA can encompass sharing or disclosing of personal information to another party. Should “sale” be interpreted to include interest-based advertising or other data uses outlined in this Policy, we will ensure compliance with the applicable law. More on this is available in our Cookie Notice, including methods to exercise your rights to opt out of interest-based advertising.

We have disclosed Personal Information in the categories identified in this section for diverse business purposes and as directed by your interactions with our Services.

CCPA Rights for California Residents

California residents under CCPA are accorded the following rights. We will honor these requests to the extent required by law and within the stipulated time by law. Where we serve as a service provider processing your Personal Information on behalf of our customers, we might refer access or deletion requests for Personal Information to our customers.

Right to Access & Information Concerning Personal Data

WizCaller provides you the privilege to request a disclosure of the categories and specific bits of Personal Information we’ve collected about you. Precisely, you can ask us to disclose the following, related to the twelve-month period preceding your request:

  • Categories and sources of Personal Information collected;
  • Our commercial or business purpose for collecting or selling such information;
  • Categories of third parties we’ve shared the information with;
  • Specific pieces of information we’ve collected about you;
  • Categories of Personal Information disclosed for monetary or other valuable consideration and to which third parties; and
  • Categories of Personal Information disclosed for a business purpose.

We are obligated to provide the required information within 45 days of receiving a verifiable request, possibly extended as per legal permissions, and can deliver through your account with us or via mail or electronically, based on your preference.

Right to Deletion of Personal Data

WizCaller grants you the right to request the deletion of your collected Personal Information, barring legally permissible exceptions or technical infeasibilities. We will inform you of the categories of data retained and the reasons for retention if deletion is not executed.

Right to Opt-Out

Currently, we do not sell your Personal Information. Should this change, this Privacy Notice will be updated, and you will have the right to instruct us not to sell your Personal Information.

Right to Non-Discrimination

Exercising the above rights under the California Consumer Privacy Act will not lead to discriminatory practices against you, including denial of goods or services, different prices or quality levels, or suggestions of differences.

However, price or quality differences may be applied if they are reasonably related to the value provided to us by your Personal Information.

If represented by an agent, they must be instructed to contact us as above. Identity verification may be required before granting access to information or acting on your requests.

Rights Regarding Data Sharing for Direct Marketing

California consumers can opt-out of our disclosing personal information to third parties for direct marketing purposes. To opt-out, contact us as described in the “How to Contact Us” section. As per Section 1798.83 of the California Civil Code, California residents can request information regarding the sharing of personal information with third parties for direct marketing purposes.

California law obligates us to disclose our response to “do not track” signals from your Web browser and whether other parties may collect information about your online activities over time and across different websites when you use our Sites. 5.6 Rights of EU, UK, and Swiss Data Subjects at WizCaller

This section is pertinent if you are a data subject from the EU, UK, or Switzerland (including the European Economic Area countries of Iceland, Liechtenstein, and Norway, and, where applicable, Switzerland). Here, “Personal Information” equates to “personal data” as defined under Regulation (EU) 2016/679 (General Data Protection Regulation, or “GDPR”).

In compliance with GDPR, WizCaller functions as both a “Controller” and a “Processor”. We control Personal Information you submit directly to us, whereas, for data provided via our Services, we process on behalf of our customers who act as the Controllers.

WizCaller operates from Canada. Any information and data are transferred to our servers in Canada and the USA, with adequate measures including encryption during transit and storage, to ensure your Personal Information’s safety. For more details, refer to “International Data Transfers”.

Usage of EU Personal Information at WizCaller

For data under our control, we collect and utilize your Personal Information to address your queries or deliver the services you have acquired or are inquiring about.

When we act as the Processor, we don’t transfer Personal Information to third parties except to our list of sub-processors and only to fulfill the services requested by our customer. Any questions regarding the use of your Personal Information should be directed to the customer acting as the Controller. Legal Bases for Processing

We rely on your consent, contractual obligations, and our legitimate interests as legal bases for processing your Personal Information:

  • Your consent guides the processing of your Personal Information, and you hold the right to retract it.
  • We process information provided by you (like name, email address, postal address, telephone number, company name, and role) in response to inquiries about WizCaller Services, which is pivotal to cater to your requests before entering into a contract.
  • Account-related data is used for setting up and administering user accounts, providing access to services, and notifying users of changes to the Services, which is essential for the performance of the contract.
  • We may send you promotional information on new products or services if you consent to receive them. If not opted-in, we might still send such information based on exceptions or our legitimate interest to promote our business.
  • We have a legitimate interest in understanding the usage of our Sites and Services and improving user experience and our offerings.
  • We have a legitimate interest in aggregating and/or anonymizing the information collected and using it for our business purposes.

Our interests do not override your interests, and we will not use your Personal Information where our interests are overridden by the impact on you unless we have your consent or are legally required or permitted. You retain the right to object to processing based on our legitimate interests.

Rights of EU, UK, and Swiss Data Subjects at WizCaller

If you are a data subject from the EU, UK, or Switzerland, you are granted several rights regarding your Personal Information under applicable law, subject to the verification of your identity.

You can request to know whether WizCaller is processing your Personal Information and if we are, receive a copy of that information and other related details. Additional copies may incur a reasonable fee.

For data that we don’t control or that has been sourced from a third party, you’ll need to contact that third party directly. We will notify other entities with whom we’ve shared your information about the rectification, and upon request, we will also inform you of these entities.

3. Right to Erasure:

You have the right to request the deletion of your Personal Information in some circumstances. If your right to deletion is outweighed by other interests, for example, compliance with law, we may not delete your data. We will inform entities with whom we’ve shared your data about the erasure and, upon request, provide you their contact details.

4. Right to Restrict Processing:

In certain cases, you can ask us to ‘block’ or restrict the processing of your Personal Information. We will inform you before lifting any restriction on processing and will notify entities with whom we’ve shared your data about the restriction.

5. Right to Data Portability:

For Personal Information obtained on or after 25 May 2018, you can request to receive your data that you consented to give us or that is necessary to perform a contract with you, in a reasonable format.

6. Right to Object:

You can object to the processing of your Personal Information at any time, and we will comply, unless we have compelling legitimate grounds for processing.

7. Rights Regarding Automated Decision-Making and Profiling:

You have the right to not be subject to decisions based solely on automated processing of your Personal Information, including profiling, unless it is necessary for a contract or with your explicit consent.

8. Right to Withdraw Consent:

If the processing is based on your consent, you can withdraw it at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.

9. Right to Lodge a Complaint:

If you have concerns about how we handle your Personal Information, you can report it to the authorized data protection authority.

You may be instructed to exercise some of your rights through your account settings, features, or by deleting your account with us if you have one.

International Data Transfers at WizCaller

When accessing our Site and Services from locations outside the United States, it’s important to note that our services are hosted and operated in Canada and the USA. Consequently, we transfer and process Personal Information in Canada and the USA. Although Canada and the USA may have different data protection laws than those in your country, we implement proper safeguards to ensure your Personal Information remains protected as per our Privacy Notice.

For transfers and processing of Personal Information from European Economic Area (EEA) member countries, the United Kingdom (UK), and Switzerland, WizCaller utilizes Standard Contractual Clauses (SCCs) as a lawful mechanism under GDPR, ensuring the protection of such information. We no longer rely on the EU-US and Swiss-US Privacy Shield Frameworks for transferring pertinent Personal Information to the USA since their invalidation in July 2020.

SCCs are terms and conditions established by the European Commission (EC) to regulate transfers of Personal Information to countries lacking an adequacy decision, like the USA. In June 2021, new SCCs were published by the EC, set to replace previous ones after a transition period. WizCaller intends to use these new SCCs as mandated by EC rules when they become applicable. If there’s a discrepancy between this Policy and the SCCs, the latter will prevail.

WizCaller is committed to addressing any complaints about your privacy and our collection or use of your Personal Information. Individuals from the European Union, UK, or Switzerland with inquiries or complaints are advised to contact WizCaller initially. Unresolved privacy or data use concerns can be referred to your local data protection authority, with whom we will cooperate to resolve the issue.

When transferring Personal Information of EU, UK, or Swiss individuals to third parties, WizCaller complies with GDPR requirements, maintaining accountability if these third parties fail to match the protection levels required by the GDPR.

EU Data Retention

Do Not Track Initiative

Do-Not-Track is an initiative aiming to create a technical “flag” or signal users can activate within their browsers to inform websites they don’t wish to be “tracked” by 3rd parties. However, the initiative hasn’t agreed on the corresponding actions to be taken by receivers of this signal. Consequently, most websites, including WizCaller, don’t modify their services or behavior upon receiving a “do-not-track” signal.

WizCaller employs cookies and other advertising technologies on our Site, where we promote our offerings, and on our customers’ sites. This segment elucidates the diverse technologies WizCaller utilizes to manage our sites and deliver ads and services. It includes services that gather information when you interact with our customers online or via phone.

5.9 Cookies

Cookies, small text files stored on your device, are instrumental for us to enhance functionality and deliver services to our clients. They retain user-specific data, such as IP address, browser type, pages visited, and interaction duration, linking your call data to your browsing activity on our customer’s website. 5.10 Log Files

Similar to most online service providers, we automatically collect specific information in log files, which includes data like IP addresses, User Agent, URLs visited, accessible via JavaScript code on our customers’ sites.

5.11 Third-Party Advertising Services

WizCaller collaborates with third-party networks and analytics providers to optimize and assess our advertisement’s performance on the internet and mobile apps. These third parties, using technologies like cookies, may monitor your activities across different websites and services, assisting in delivering targeted advertisements. These third-party technologies operate independently, even when using our technology to collect or store data. It’s crucial to review their terms, privacy policies, and permissions regarding their data practices. WizCaller doesn’t claim any representations regarding the policies or practices of third-party advertisers or tracking technology providers.

Opt-Out Options

For opting out of interest-based ads, you can visit sites like the Network Advertising Initiative (NAI) at www.networkadvertising.org/choices, the Digital Advertising Alliance (DAA) at www.aboutads.info/choices/control, or the European Digital Advertising Alliance (EDAA) at www.youronlinechoices.com. Opting out from these organizations implies that their members, as per their rules, can’t deliver targeted content/ads. However, it doesn’t guarantee the cessation of receiving targeted content/ads.

Remember, if your browser is set to reject cookies or if cookies are deleted subsequently, the opt-outs might become ineffective. WizCaller isn’t accountable for the efficacy of or adherence to any third parties’ opt-out options.

5.12 Usage of Google Analytics

WizCaller utilizes Google Analytics, a service offered by Google, to gain insights into user interaction with our Site and Services. Google Analytics aids in understanding user behaviors like the frequency of visits, the pages accessed, and the websites visited before ours. The collected data allow Google to evaluate the use of our Site and to generate reports on site activities, possibly personalizing its advertising network’s ads based on this data. Non-WizCaller customers can request corrections and updates to Personal Information by reaching out to us through the contact details provided in the “How To Contact Us” section.

WizCaller customers wishing to amend billing information can do so by logging into their accounts and navigating to the Billing section or contacting WizCaller support for more assistance regarding Personal Information: WizCaller Support. To terminate the Service, submit a request through WizCaller support. Responses to corrections or update requests will be addressed within a maximum of 30 days from the request date.

5.14 Retention and Deletion of Data

WizCaller retains Personal Information for as long as it is needed to deliver Services, fulfill its intended purposes, or as mandated by contractual or legal obligations.

The duration for which we retain data is determined by the existence of a relationship with you, any legal obligations mandating specific retention periods, the purposes for processing your data, and the potential risks arising from unauthorized access or disclosure.

We might also anonymize or de-identify Personal Information for analytical purposes, ensuring it cannot be linked back to you. Such anonymized data can be used indefinitely, as long as it serves a legitimate business purpose, without additional notice.

If we are processing Personal Information on behalf of a customer, the retention or deletion of such data is subject to the customer’s preferences and instructions. If an WizCaller customer terminates their account for any reason, there is no assurance regarding the retention of the customer’s data post-termination.

6 WizCaller Confidentiality, Security, and Privacy

6.1 Security & Confidentiality

WizCaller employs stringent measures to maintain the confidentiality and security of information amassed from our customers and site visitors. Access to such information is restricted to WizCaller employees, affiliates, or other personnel who require this information to offer services or for conducting regular business activities. Our company adopts substantial physical, electronic, and procedural safeguards to shield the information obtained through the Sites and Services.

WizCaller’s employees are enlightened about their roles in safeguarding customer data and Personal Information, and we offer guidelines to adhere to the company’s ethics standards and privacy-related policies. Despite adopting multifarious security measures, we cannot guarantee absolute security. It is crucial to note that the safety measures incorporated to protect Personal Information are not foolproof and may fail or may not be adequate all the time.

If any WizCaller Sites feature message boards or other interactive forums administered directly by us, be cautious about sharing personal information in such public areas as they can be accessed and used by unknown individuals. We can’t ensure the privacy and safety of these public forums and are not responsible for any information shared there. The utilization of such features is solely at the user’s risk.

6.4 Engagement with WizCaller on Social Media and Online Platforms

Engagement or sharing of any kind of content, communications, or information on WizCaller’s pages situated on social media or any online platform is conducted at the user’s own risk, without anticipation of privacy. WizCaller doesn’t have control over actions taken by other users on these platforms, hence doesn’t hold responsibility for any content or submission on these platforms. Visiting and interacting with our pages represent your agreement to the applicable policies and terms of use of the respective platforms.

Moreover, if WizCaller Sites provide message boards or other user-interactive features, users are advised to be cautious about sharing personal information as these can be publicly accessed.
